Welcome to GetAHomePro. These Terms of Service (“Terms”) govern your access to and use of the GetAHomePro website and services (collectively, the “Service”) operated by GetAHomePro (“we,” “our,” or “us”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
1. Description of Service
GetAHomePro is a two-sided marketplace platform that connects homeowners seeking home services with licensed, insured contractors. Our Service includes:
- A directory of home service contractors across 2,026 cities in the United States and Canada
- Cost guides and pricing data for 17 home service categories
- A lead matching system that connects homeowner requests with qualified contractors
- A contractor portal with tools for managing leads, subscriptions, and business profiles
- An AI-powered search feature to help homeowners find relevant services
- Call tracking services for contractors
GetAHomePro is a marketplace platform and is not a contractor, subcontractor, or home service provider. We do not perform, guarantee, or warranty any home service work.
2. User Accounts
2.1 Account Registration
Contractors must create an account to access the contractor portal and purchase leads. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
2.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
2.3 Account Termination
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or for any other reason at our sole discretion.
3. Homeowner Terms
3.1 Free Service
GetAHomePro is free for homeowners. There are no fees, commitments, or obligations associated with submitting a quote request or receiving contractor matches.
3.2 Lead Submissions
When you submit a quote request, your project details and contact information will be shared with matched contractors in your area. By submitting a request, you consent to being contacted by these contractors via phone, email, or text message regarding your project.
3.3 No Guarantee
We do not guarantee that you will receive quotes, that contractors will be available in your area, or that the cost estimates displayed on our website will match actual contractor pricing. Cost data is provided for informational purposes only.
4. Contractor Terms
4.1 Eligibility
By registering as a contractor, you represent and warrant that:
- You hold all required licenses and permits for the services you offer in your service areas
- You maintain adequate commercial general liability insurance
- You are authorized to conduct business in the jurisdictions where you operate
- All information provided in your profile is accurate and current
4.2 Verification
We may request verification of your business credentials, including licenses, insurance certificates, and background checks. Failure to complete verification may result in reduced visibility or account suspension.
4.3 Lead Purchases and Auctions
Leads are sold on a credit-based system. Once a lead is purchased or won through an auction, the transaction is final. Refunds may be issued at our sole discretion in cases where the lead information is materially inaccurate or the homeowner is unreachable.
4.4 Subscriptions
Contractor subscriptions are billed monthly through Stripe. Subscription details:
- Basic ($49/month): Core lead access and profile features
- Pro ($149/month): Enhanced visibility, auction access, and call tracking
- Premium ($299/month): Priority lead access, dedicated support, and advanced analytics
Subscriptions renew automatically until cancelled. You may cancel your subscription at any time through your Billing dashboard. Cancellations take effect at the end of the current billing period. No prorated refunds are issued for partial months.
4.5 Contractor Conduct
Contractors agree to:
- Respond promptly and professionally to all leads
- Provide accurate and competitive quotes
- Maintain the quality of work represented in their profile
- Not engage in deceptive pricing, bait-and-switch tactics, or harassment
- Comply with all applicable federal, state/provincial, and local laws and regulations
5. Contractor Relationships
Contractors listed on GetAHomePro are independent businesses and are not employees, agents, or representatives of GetAHomePro. We do not:
- Employ, supervise, or direct the work of any contractor
- Set contractor prices or negotiate on behalf of either party
- Guarantee the quality, safety, or legality of any contractor’s work
- Provide warranties or insurance coverage for completed projects
Any agreement between a homeowner and a contractor is solely between those two parties. GetAHomePro is not a party to and bears no responsibility for any such agreement.
6. Payment Terms
6.1 Payment Processing
All payments are processed securely through Stripe. By making a purchase, you agree to Stripe’s Terms of Service. We do not store credit card numbers on our servers.
6.2 Credits
Lead credits are non-refundable and non-transferable. Credits do not expire but have no cash value and cannot be redeemed for cash.
6.3 Pricing Changes
We reserve the right to change subscription pricing, credit pricing, and lead pricing at any time. Existing subscribers will receive 30 days’ notice before any price increase takes effect on their account.
7. Intellectual Property
The Service, including all content, features, and functionality (including text, graphics, logos, icons, images, audio clips, data compilations, and software), is owned by GetAHomePro and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may not:
- Reproduce, distribute, or create derivative works from our content without written permission
- Use automated tools (scrapers, bots) to extract data from the Service
- Remove or alter any copyright, trademark, or other proprietary notices
- Use our trademarks or branding without written authorization
8. User Content
By submitting content to the Service (reviews, messages, profile information), you grant GetAHomePro a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Service. You represent that you own or have the right to submit any content you provide.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMESERVICEPRO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or business opportunities
- Property damage or personal injury resulting from contractor work
- Disputes between homeowners and contractors
- Service interruptions, errors, or inaccuracies in cost data
- Unauthorized access to or alteration of your data
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO HOMESERVICEPRO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. Cost estimates, contractor ratings, and other data are provided for informational purposes only and may not reflect current market conditions.
11. Indemnification
You agree to indemnify, defend, and hold harmless GetAHomePro and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit through the Service
- For contractors: any services you perform for homeowners found through the Service
12. Dispute Resolution
12.1 Informal Resolution
Before filing a formal claim, you agree to attempt to resolve any dispute informally by contacting us at legal@getahomepro.co. We will attempt to resolve the dispute within 30 days.
12.2 Arbitration
If a dispute cannot be resolved informally, you agree that any claims arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in New York, New York, and the arbitrator’s decision shall be final and binding.
12.3 Class Action Waiver
You agree that any arbitration or litigation shall be conducted on an individual basis and not as a class action, class arbitration, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. For Canadian users, the applicable provincial and federal laws of Canada shall apply to the extent they override these Terms.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and GetAHomePro regarding your use of the Service and supersede all prior agreements and understandings.
